This Creator Agreement defines expected conduct and compliance for creators whose work is reviewed, broadcast, or promoted by AI Radio SA (powered by FLAM Tunes). This is a moderation-first ecosystem.
It also applies to related FLAM Tunes features and services, including artist worlds, artist dashboards, upload tools, submission review, music and video pages, playlists, embeds, analytics, notifications, community or campaign features, and future tools that support the same creator ecosystem.
1. Identity and authenticity
- No impersonation, fake identities, or deceptive affiliation claims.
- No celebrity voice cloning or unauthorized voice replication.
- No deceptive “sound exactly like” submissions designed to confuse listeners.
2. Rights and provenance
- You are responsible for rights clearance (stems, samples, vocals, collaborations).
- Where possible, submit using Suno share links to retain traceability and provenance.
- Keep evidence of authorship and permissions available on request.
2A. Ownership and no transfer of copyright
You retain ownership of your music, sound recordings, compositions, artwork, artist name, image, likeness, biography, and metadata, subject to any rights owned by collaborators, producers, publishers, labels, or other rights holders. Nothing in this Agreement transfers copyright ownership to AI Radio SA, FLAM Tunes, or FLAM Records unless a separate written agreement expressly says so.
2B. Licence to operate, stream, promote, and display approved content
For content you submit or make available for review, you grant AI Radio SA, FLAM Tunes, and FLAM Records a non-exclusive, worldwide licence to host, store, make technical copies of, review, stream, broadcast, display, market, promote, and otherwise use the content as reasonably needed to operate the platform, AI Radio SA, FLAM Worlds, artist pages, playlists, social media, email, editorial, and related promotional surfaces.
Where FLAM Tunes separately agrees to distribute or deliver content to third-party platforms, that distribution is subject to the applicable written commercial terms, release approval, dashboard confirmation, or other written release-specific agreement for that content.
2C. Artist materials
You grant permission to use your artist name, stage name, approved image, likeness, biography, artwork, release information, links, credits, and metadata in connection with review, curation, streaming, promotion, marketing, artist-world pages, playlists, announcements, and platform communications.
2D. Duration of licence
The licence continues while your content is submitted, under review, approved, hosted, streamed, broadcast, promoted, or otherwise active in the FLAM Tunes ecosystem. After termination or removal, AI Radio SA / FLAM Tunes may retain copies as reasonably required for legal, archival, audit, dispute, security, backup, or record-keeping purposes, and previously published promotional posts or cached third-party materials may remain where immediate removal is not technically practical.
2E. Revenue and payment terms
Unless a separate written agreement, release schedule, dashboard confirmation, or approved commercial term expressly provides otherwise, submission, review, broadcast, listing, promotion, or inclusion in the FLAM Tunes ecosystem does not create a payment, royalty, advance, revenue-share, or accounting obligation. If a revenue-share or payment arrangement applies, payment will be made according to the applicable written commercial terms, subject to platform reporting, actual receipts, refunds, chargebacks, taxes, payment thresholds, and accurate payment details supplied by the artist.
2F. Confidentiality
If FLAM Tunes or AI Radio SA shares non-public information with you, including unreleased plans, private dashboards, moderation notes, artist data, campaign strategy, financial information, login access, technical information, or private communications, you must keep that information confidential and may not disclose it without written permission, except where disclosure is required by law.
3. Trust tiers and strikes (lightweight)
We may assign creators a trust tier (e.g. new / trusted / probation) and track strikes for repeated or serious policy violations. A strike may be issued for suspected fraud, repeated impersonation attempts, or verified infringement complaints.
4. Enforcement
- We may reduce rotation, restrict promotion, or remove content at any time.
- We may decline future submissions if risk is high or trust is broken.
4A. Takedowns, complaints, and disputes
If AI Radio SA / FLAM Tunes receives a credible rights complaint, infringement notice, platform warning, or other dispute involving your content, we may disable, remove, restrict, or pause the content while the matter is reviewed. You may be asked to provide proof of rights, permissions, identity, authorship, or provenance. If the dispute is not resolved to our reasonable satisfaction, we may keep the content disabled or remove it permanently.
4B. Termination and removal requests
Either party may end the creator relationship or request removal of active content by written notice. Following a valid removal request, AI Radio SA / FLAM Tunes will use reasonable efforts to remove the relevant content from active platform-controlled surfaces within a reasonable time. Termination does not affect rights or obligations that arose before termination, including confidentiality, indemnity, payment obligations that are expressly agreed, dispute handling, and record retention.
5. Promotion separation
Broadcast approval does not automatically qualify a track for promotion on TikTok/YouTube/Instagram/Facebook. Promotion is a separate risk-based decision.
5A. Data protection and privacy
Personal information is handled according to the FLAM Tunes Privacy Policy. You agree that we may process artist contact details, submission information, metadata, rights information, moderation records, analytics, and communications as reasonably needed to operate the platform, manage submissions, handle disputes, promote approved content, comply with law, and protect the integrity of the ecosystem.
5B. Indemnity clarification
Your indemnity includes claims, losses, damages, costs, and expenses arising from rights breaches, copyright or neighbouring-rights claims, unauthorized samples, stems, vocals, likenesses, artwork, metadata, impersonation, fraud, inaccurate disclosures, misleading ownership claims, or other misrepresentations connected to your content, except to the extent caused by our wilful misconduct or gross negligence.
