1. Artist Eligibility

To become an artist on Flam Tunes, you must meet the following requirements:

• Be at least 18 years of age or have parental/guardian consent
• Possess full rights to all content you upload or have written authorization from all rights holders
• Provide accurate and complete artist profile information, including a valid South African bank account for payouts
• Verify your identity in accordance with our verification process
• Accept and comply with these terms, our Terms of Service, and Community Guidelines

2. Content License

By uploading content to Flam Tunes, you grant us a non-exclusive, worldwide, royalty-bearing license to:

• Reproduce, distribute, stream, sell, and otherwise make your music available to users
• Use your name, likeness, artwork, and metadata in connection with the promotion and distribution of your content
• Sub-license your content to third-party streaming partners and distributors as necessary to deliver the Service
• Create and distribute promotional materials featuring your content

This license continues for the duration your content is available on the platform and for a reasonable wind-down period after removal to allow for caching and distribution partner updates.

3. Revenue Share Model

Flam Tunes operates on a transparent revenue share model. You retain the following percentage of gross revenue generated from your content:

• Streaming: 70% to artist, 30% platform fee
• Downloads: 85% to artist, 15% platform fee
• Tips: 95% to artist, 5% processing fee
• Merchandise: 90% to artist, 10% platform fee
• Event Tickets: 90% to artist, 10% platform fee

Payment Terms

• Payments are made on a 30-day NET basis (e.g., January earnings paid by end of March)
• Minimum payout threshold: R500 (South African Rand)
• Amounts below the minimum roll over to the next payment cycle

4. Content Requirements

4.1 Quality Standards

• Audio: Minimum 44.1kHz / 16-bit WAV or equivalent quality; we recommend 48kHz / 24-bit for optimal delivery
• No excessive clipping, distortion, or encoding artifacts
• Videos: Minimum 720p resolution, properly encoded in supported formats

4.2 Metadata Requirements

• Accurate song titles, artist names, featured artists, and album information
• Correct genre and release date
• Credits (producer, songwriter, etc.) where applicable

4.3 Artwork Specifications

• Minimum 3000×3000 pixels, square format
• Supported formats: JPEG, PNG
• No unlicensed imagery, offensive content, or misleading imagery

5. Exclusivity

This agreement is non-exclusive. You retain full ownership of all rights to your content and are free to:

• Distribute your music on other platforms (Spotify, Apple Music, Bandcamp, etc.)
• License your music to third parties independently
• Perform and monetize your work outside of Flam Tunes
• Terminate distribution on Flam Tunes at any time subject to the notice period in Section 9

Flam Tunes does not claim exclusive rights to your content. We simply require the license set forth in Section 2 to operate the Service.

6. Prohibited Content

You may not upload or distribute content that:

• Infringes copyright: You must own or have written clearance for all musical compositions, sound recordings, samples, and artwork
• Contains explicit content without warnings: Content with explicit language or mature themes must be properly tagged; failure to do so may result in removal
• Constitutes hate speech: Content that promotes discrimination, violence, or hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics is strictly prohibited
• Violates South African law or our Community Guidelines

We reserve the right to remove any content that violates these standards, with or without notice. Repeated violations may result in account suspension or termination.

7. Analytics and Reporting

Flam Tunes provides tools to help you understand your performance:

• Monthly Statements: Detailed revenue statements are issued within 15 days of each calendar month end, showing streams, downloads, tips, merchandise, and ticket sales
• Real-Time Dashboard: Access your artist dashboard at any time to view streaming stats, listener demographics, geographic distribution, and earnings
• Export: You may export your data for personal record-keeping and tax purposes

8. Payment Terms

• South African Bank Accounts: Payouts are made exclusively to verified South African bank accounts (FNB, Absa, Standard Bank, Nedbank, Capitec, and other major South African banks)
• Processing Times: After the 30-day NET period, payouts are processed within 14 business days of the payment run date
• Tax Obligations: You are responsible for declaring and paying all applicable taxes (income tax, VAT if registered) on your earnings. Flam Tunes may be required to report earnings to the South African Revenue Service (SARS) where legally mandated
• Currency: All payments are made in South African Rand (ZAR)

9. Content Removal

9.1 Artist-Initiated Removal

You may remove your content from Flam Tunes at any time. We request 30 days' written notice to allow for distribution partner updates and caching. Upon removal, your license to us terminates (subject to wind-down for technical purposes). Revenue earned prior to removal will be paid in accordance with Section 8.

9.2 Platform-Initiated Removal

Flam Tunes may remove content immediately, without notice, if we reasonably believe it violates these terms, our Community Guidelines, or applicable law. We may also remove content in response to valid legal requests (e.g., DMCA takedown, court order). In such cases, no revenue from the removed content will be paid for the period in which it was in violation.

10. Termination

Either party may terminate this agreement at any time:

• By You: Submit a termination request through your artist dashboard or by email. Your content will be removed in accordance with Section 9.1 (30-day notice)
• By Flam Tunes: We may suspend or terminate your artist account for breach of these terms, fraud, or at our discretion with 30 days' notice

Content Removal Process

Upon termination, remaining content will be removed from the platform. You will receive any outstanding payments for revenue earned prior to termination, subject to the minimum payout threshold and our standard payment schedule.

11. South African Law

This Artist Distribution Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any disputes arising from or relating to this agreement shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached within 30 days, either party may refer the dispute to arbitration in South Africa in accordance with the Arbitration Act 42 of 1965, before resorting to litigation in the courts of South Africa.
